Abstract

The decomposition of the ethos of conventional societies in Modernity split morality and ethics, but the philosophy of the subject and the metaphysical separation between natural and positive law led to a concurrence between liberalism that founded the human rights of the individual, as a subject in small scale, in rational morality, while republicanism anchored popular sovereignty in a people, as a large-scale subject, who recognizes the ethical values of the community, even in the debate between liberalism and communitarianism in North America. But, the theory of communicative action overcomes this recurring aporia because it enables an intersubjective understanding of law as responsible for the social integration between the communicative rationality of the world of life and the strategic rationality of social systems, politics and the economy, since It simultaneously allows private autonomy and public autonomy so that social agents act for the facticity or validity of the right at the level of legal norms, of the system of rights.
